This session will review “deepfakes” and examples of their use or misuse in litigation. It will also explore the concept of the “liar’s dividend” (a term used by Professors Danielle Criton and Robert Chesney), which is the exploitation of the possible dangers of deepfakes to create doubt and distrust in otherwise truthful or factual matters, akin to the “CSI effect” that trial lawyers experience in complicated prosecutions.
