Durable Powers of Attorney (“DPOAs”) are a less restrictive alternative to guardianship/conservatorship. You can include provisions in a DPOA that allow the Agent to preserve your client’s estate plan, outline specific instructions for your client’s care, and utilize gifting strategies to allow your client to qualify for Medicaid.
