This installment of the Legal Lunchbox™ Series looks at Washington’s General Rule 37, adopted to “to eliminate the unfair exclusion of potential jurors based on race or ethnicity.” Faculty discuss persistent bias in jury selection, and how GR 37 goes beyond Batson v. Kentucky, 476 U.S. 79 (1986), to address the problem. Also discussed is the impetus for GR 37 and the process by which the rule was adopted.
