Description: Seattle lawyer Randall Hall (WSBA No. 6161, admitted 1975) has been ordered censured by the Disciplinary Board, which on December 10, 1997, approved his stipulation to discipline. The discipline is based on Hall’s failure to (1) diligently represent two clients in their appeal before the Board of Immigration Appeals in violation of RPC 1.3, and (2) notify the two clients of his withdrawal and take reasonably practicable steps to protect their legal interests in violation of RPC 1.15. Hall was also ordered to make restitution in the amount of $2,000.
Hall was hired in May 1992 to represent two brothers from El Salvador who were seeking asylum in the United States. In August 1992, the immigration judge denied the brothers’ request for asylum but ordered that they be given the privilege of voluntary departure. Hall filed a notice of appeal on behalf of the brothers with the Board of Immigration Appeals, but he failed to file an appellate brief on their behalf. Hall ceased working on the brothers’ appeal, but he never informed them of his withdrawal or took the appropriate steps to protect the brothers’ interests in connection with the appeal.
In January 1993, the Board of Immigration Appeals dismissed the brothers’ appeal on the grounds that they did not file a brief identifying the basis for appeal. In addition, the brothers lost the privilege of voluntary departure. By the time the brothers received the deportation notice from INS in July or August 1993, the deadline to file a judicial appeal of the summary dismissal by the Board of Immigration Appeals had expired.
Hall represented himself. The Bar Association was represented by Disciplinary Counsel Jonathan Burke.
