Developed in partnership with the WSBA International Practice Section
In the December 2023 Canadian ruling of Bjorkquist et al. v. Attorney General of Canada, the definition of who is entitled to Canadian citizenship by descent was deemed unconstitutional. Since then, the Canadian government has put measures into place allowing many individuals with Canadian ancestry to confirm their citizenship status--even after several generations in the United States. These measures have far-reaching implications for businesses whose employees may have claims to Canadian citizenship, families, and individuals contemplating a move to Canada or who wish to obtain a Canadian passport. This session will provide an overview of current and previous Canadian citizenship eligibility, the Bjorkquist ruling and expansion of who is eligible for citizenship, and the process for “lost Canadians” to claim citizenship.
