This presentation will provide an overview of what it is like to practice law in the international criminal courts in The Hague. It will discuss the nature of the “hybrid” mix of law which governs proceedings in the ICL courts, the issues which arise when conducting trial preparation investigations in post-conflict zones, and the practical challenges for lawyers working in multi-cultural, multi-lingual international institutions. It will also comment on developments in international law which are being adopted in domestic jurisdictions, such as the increased use of protected witnesses, the provision of heavily redacted discovery to counsel, closed and private sessions in trials which are meant to be public, and the use, in domestic jurisdictions, of internationally developed theories of liability such as joint criminal enterprise.
